DELINQUENCY
Cases involving children under age 17 are handled by the Family Division of the Circuit Court. This includes but is not limited to the following offenses:
Cases involving a minor under age 17 who has either been accused of committing an offense that would be considered criminal if committed by an adult.
A status offense where a minor repeatedly disobeys his or her parents (incorrigibility), fails to attend school (truancy) or runs away from home (runaway).
Juveniles who commit offenses after age 17 are referred to adult criminal court (District or Circuit Court). Juveniles over age 17 may not be charged with status offenses.
Each charge/offense is reviewed by the Marquette County Prosecuting Attorney's Office. If a petition is authorized, it is submitted to the Juvenile Court for processing. Once received by the Juvenile Court, an intake is completed and reviewed by the Director of Juvenile Court to determine whether the petition should be handled formally or informally.
CHILD ABUSE/CHILD NEGLECT
Cases involving abuse or neglect by a caretaker of a child under 18 years of age are also referred to the Family Division of the Circuit Court.
Abuse/neglect allegations are investigated by the Children’s Protective Services Division of the Department of Human Services (DHS). A prosecutor reviews all petitions before they are filed with the court, and acts as legal counsel for DHS once the case comes to court. Caseworker services for abuse/neglect cases are provided by DHS employees.
